Heard the learned counsel appearing for the Applicant/accused as well as the learned APP for the State. Learned APP points out that all other accused-persons are already released on bail.

Perused the papers of investigation including the FIR. The allegations against the present applicant/accused are to the effect that he assaulted the injured by means of stick. No sharp edged weapon is attributed to the present applicant. Considering the nature of the allegations against the present applicant his custodial interrogation is not warranted and, therefore, the following order : 1/3

ORDER

i. The application is allowed.

ii. In the event of his arrest, the applicant/accused in Crime No. 143 of 2016 registered with Akkalkot South Police Station Dist. Solapur for the offence punishable under sections 307, 143, 147, 148, 149, 323, 504, 506 of the Indian Penal Code at the instance of informant-Rajkumar S.Mashale, be released on bail on executing PR Bond in the sum of Rs. 5000/- and on furnishing solvent surety in the like amount.

iii. As a condition of this order, the Applicant should attend the concerned police station on 3rd and 10th July, 2016 between 11 a.m. to 1 p.m. and he should co-operate the investigating officer.

iv. In addition, the Applicant/accused is directed that he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of accusation against him so as to dissuade such person from disclosing such facts either to the Court or to any police officer and 2/3

that applicant shall not tamper with the prosecution evidence in any manner.

v. The applicant should not commit offence of similar nature in future.

The application is disposed of accordingly.
