Interim order granting maintenance to the wife passed by the Magistrate, 69 th Court, Mazgaon, Mumbai was challenged in Criminal Appeal

Rane 2/2 WP-2701-2019 (sr.18) 11.10.2021 No.192/23018. The Appellate Court dismissed the Appeal on 3 rd April, 2019. Against this order, the petitioner-original respondent has filed this Writ Petition. On 13 th September, 2021, the petitioner was directed to verify the arrears of maintenance due and payable to his wife as granted by the learned Magistrate on 9 th March, 2018. The learned Counsel for the petitioner submits that, he could not establish contact with the petitioner. On the other hand, the learned Counsel appearing for the respondents, on instructions, submits that, as on today, arrears are around Rs.13,50,000/-. It is further submitted that the learned Magistrate has issued warrant of attachment to recover the arrears of maintenance. The statement is accepted.

In view of the facts of the case, I am not inclined to interfere with the orders passed by the Courts below. The petition is dismissed.
