Heard learned counsel for the parties.

By this application, the applicant seeks suspension of his sentence, pending the hearing and final disposal of the aforesaid Revision Application.

The applicant vide Judgment and Order dated 21st January 2019, passed by learned Additional Chief Judicial Magistrate, Pune in Regular Criminal Case No.2739 of 2014, has been convicted for the offence punishable under Section 498-A of the Indian Penal Code. The said 1/3

Judgment and Order was confirmed by the learned Additional Sessions Judge, Pune in Criminal Appeal No.77 of 2019, vide Judgment and Order dated 16th March 2021.

Learned Counsel for the applicant submits that the applicant was on bail pending trial as well as during the pendency of his appeal and that he has not misused or abused the conditions of bail. He submits that the applicant sanguine to succeed in the same. The Revision has been admitted by a separate order passed today. The same is not likely to be heard in the immediate near future.

Considering the aforesaid, the application is allowed and the applicant's sentence is suspended and he is enlarged on bail, pending the hearing and final disposal of his Revision Application, on the following terms and conditions :-

ORDER

i) The Applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount; ii) The Applicant shall keep the trial Court informed of his current address and mobile contact number and/or change of residence or mobile details, if any, from time to time.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
