After hearing the learned Advocate for Petitioner at length, when this Court was not inclined to grant any relief, learned Advocate on instructions seeks leave to withdraw present Petition with liberty to file appropriate Application before the trial Court under the provisions of Section 216 of Criminal Procedure Code. It is needless to note here that, if the Petitioner files such an Application, the learned Judge of the trial Court will decide it as per the provisions of law and without being influenced by the said liberty granted by this Court.
