Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail by the applicant- Sonu Surajbhan Ujainwal, in connection with C.R. No.I-232 of 2018 dated 02/10/2018, registered with Ulhasnagar Police Station, under sections 302, 323 read with 34 of the Indian Penal Code, 1860.

It is alleged that the applicant and 2 others assaulted the deceased. Initially, the deceased was assaulted by fist and kick blows. After the deceased started running 3 accused chased him. It is alleged that the present applicant 1/2

Darshan Patil 9-ba-1819-22.odt with the other accused, assaulted the deceased on his head, with a paver block. There are eyewitnesses who have seen the applicant assaulting the deceased.

Learned counsel for the applicant submitted that the applicant is in custody for 4 years and 6 months. It is further submitted that the applicant is partially disabled and has a steel rod inserted in his legs.

Considering the manner in which the offence is committed I am not inclined to enlarge the applicant on bail. The application is rejected.

Learned counsel for the applicant makes a request to expedite the trial. Considering the applicant is in custody for more than 4 years and 6 months, if a request for expediting the trial is made to the trial court, the same shall be considered on its own merits.

The application is disposed of.
