Heard learned counsel for the Petitioner and the learned AGP appearing for Respondent No. 3. No one is appearing in spite of notice for Respondent Nos. 1 and 2.

The grievance of the Petitioner is that Respondent Nos. 1 and 2 are not issuing No Objection Certificate to the Petitioner after the Petitioner had withdrawn admission from Respondent No. 2 - College in 11th standard. According to the Petitioner, though the Respondents have issued the School Leaving certificate and original Mark Sheet to the Petitioner but in spite of repeated requests, Vishal Parekar 1/2

5-wp-6751-2016 Respondent Nos. 1 and 2 are not issuing No Objection Certificate in favour of the Petitioner.

Having considered the submissions made by the learned counsel for the parties, we find that Respondent Nos. 1 and 2 have not come forward to justify their inaction in not issuing No Objection Certificate in favour of the Petitioner. Thus, in our considered view when the Petitioner has withdrawn the admission and got it cancelled and he has been issued the leaving certificate and 10th standard Mark Sheet, there may not be any reason for not granting No Objection Certificate in favour of the Petitioner. In the circumstances, we dispose of this Petition by directing Respondent No. 2/College to issue No Objection Certificate to the Petitioner as desired in this Petition as expeditiously as possible but not later than five days from the date of receipt of copy of this order.

The parties to act on the authenticated copy of this order. The Petition stands disposed of as such.
