The Petition is filed by the Petitioner-wife challenging the order dated 27th May, 2015 thereby rejecting the application filed by the Petitioner under Order 6 Rule 17 of the Civil Procedure Code and also challenging the order dated 6th May, 2015 wherein the Court directed the Petitioner to proceed with the argument. 2.
On perusal of the Petition, it is found that the application for custody and the other application, both are pending before the trial Court since long and the evidence in both the matters is already over. The Respondent has filed notes of arguments(Exh-40) dated 1st 1 / 2
10-wp-5925-2015.doc March, 2013 and since the matter is pending for the argument of the Petitioner-wife. The Court has observed that the matters are pending because the adjournments are sought and the Petitioner-wife is not taking steps in the progress of the Petition. 3.
Considering these facts and the reasoned orders passed by the Family Court, I am of the view that this Petition is to be dismissed summarily as no illegality is seen.

Hence, the Petition stands dismissed.
