1] The learned counsel for the petitioner seeks leave to withdraw this petition with liberty to institute a substantive writ petition questioning the purported acquisition of the suit property, inter alia on the ground that till date possession of the suit property has not yet been taken and further, the petitioner has not even paid any compensation towards the purported acquisition. 2] Leave is granted with liberty as prayed for.

3] It is made clear that this Court has not adverted to the merits of the matter and only the contention of the petitioner as aforesaid, is recorded.
