Heard the learned Counsel appointed for the applicant and the learned APP for State.

Learned Counsel appointed for the applicant submits that after perusing the copy of the application, the learned Counsel appointed for the applicant had made an application before the Addl. Chief Metropolitan Magistrate, 24th Court, Boriwali Division to refund the cash security of Rs. 7,000/- to the applicant as he was acquitted in 1/3

C.C. No. 994 of 1993 by Judgment and order dated 14/1/2010. The learned Counsel for the applicant submits that the Addl. Chief Metropolitan Magistrate has passed an order granting refund of the amount of Rs. 7,000/- and the applicant would take steps in accordance with law. In view of this, the prayer in the present application has become infructuous. Hence the application is dismissed as infructuous and disposed of accordingly. The learned counsel appointed for the applicant has put in the best of the efforts to espouse the cause of the applicant. The professional fees is quantified at Rs. 2,000/- to be paid to the learned Counsel Mr. Kezer Kharawala within 3 months from today. Office to communicate this order to the applicant who is in jail.
