Heard the learned counsel appearing for the Applicant and the learned additional public prosecutor for the State.
The Applicant has prayed for return of the passport which was seized by the police during the course of investigation of crime no. 39 of 2008 by the EOW Unit-I. The investigation has been completed and the charge-sheet has been filed vide criminal case no. 988/PW/2008 in the 47th court of Metropolitan Magistrate, Mumbai. The Applicant is a permanent resident of Mumbai as such there was no apprehension that he will evade the trial. More over, the Borey 1/2
spb/ 913appln284-14.sxw learned counsel has submitted that the applicant will not leave India without prior permission of the trial court. In view of the statement on the part of the applicant, I pass following order : Pass-port of the applicant, lying with EOW Unit-I shall be returned to him forthwith by retaining a xerox copy thereof.
