By this Petition under Article 226 of Constitution of India, the Petitioner is seeking direction against the Sub Divisional Officer, Ichalkaranji Sub-Division, Ichalkaranji, to take appropriate decision on the Petitioner'

s pending representation in respect of plot No.195, situated at Gaonthan, village Rangoli, Taluka Hatkanangale, District Kolhapur, within stipulated time. Nesarikar

The Respondent State filed their affidavit in reply dated 13/02/2020 stating that thereafter the Petitioner filed the application dated 04/09/2016 for the same cause of action and that was decided by them on 05/12/2016. The copy of the order dated 05/12/2016 is placed on record at Ex.A to the affidavit in reply at page No.52.

Learned Counsel Mr.Manoj A. Patil for Petitioner submits that in view of this subsequent development, that the Petitioner's application for same cause of action dated 04/09/2016 is decided by the Respondent by order dated 05/12/2016, the Petitioner may be permitted to withdraw the present Writ Petition with liberty to file appropriate proceedings to challenge the same. To that effect he has given writing. Same is taken on record and marked '

X' for identification. Same is accepted.

Writ Petition stands disposed of as withdrawn with liberty as prayed for.
