None appears. The application seeking leave to appeal is allowed. Appeal admit. Action under Section 390 of Code of Criminal Procedure be taken against Respondent no.1. The respondent no.1 shall continue to appear before the learned Magistrate once in six months on the date assigned by the learned Magistrate. Upon failure to attend any two consecutive dates, the learned Magistrate shall report the same to the High Court and the prosecution would be at liberty to file an application under Section 439(2) of Cr.P.C. seeking cancellation of bail.
