DATE : 6 MARCH 2023 P.C. :- The Petitioners have challenged the orders dated 9 May 2022 and 11 May 2022 passed by the Recovery Officer, Debt Recovery Tribunal-II, Mumbai. The Petitioners have also sought fresh valuation to be carried out. As the pleadings and prayers would indicate the date of taking physical possession was notified on 22 June 2022. While directing that the petition will come up in due course, ad-interim relief was rejected by this Court. Thereafter, the petition remained pending. It appears that the petition has become infructuous therefore, none appears for the Petitioners. The writ petition is dismissed for non-prosecution.
