The Appeal is directed against the order dated 8 May 2019 whereby, learned Judge declined the ad-interim relief. 2.

Mr.R.S. Apte, learned Senior Counsel for the Appellant states that the Application at Exhibit-5 was already heard on merits, however, the same could not be disposed of, in view of the transfer of the Judge. Since, the Application at Exhibit-5 is ready for hearing and the pleadings are complete and Application is also ready for hearing, this Appeal can be disposed of by directing the Learned CJSD, Pune N.S. 27-ao-1069-2019 with caa-1222-2019 to dispose of the Application at Exhibit-5 as expeditiously as possible and in any event within two months.

It is made clear that this Court has not expressed any opinion on the merits of the matter. So the learned Judge shall decide the Application on its own merits.

The Appeal as well as the Application stands disposed of in above terms.
