The learned APP at the outset submits that in thepresent case, charge is framed against the accused and today, i.e. on 10/1/2017 trial was scheduled for considering application under section 294 of the Code of Criminal Procedure, 1973. It is in these circumstances, it would not be appropriate to consider the application for enlargement on bail under section 439 of the Code of Criminal Procedure, 1973. Talwalkar 1/2

21.ba1184.16.sxw The learned Counsel for the applicant fairly submits that since the trial has commenced, trial be expedited and hence prays, upon instructions, for withdrawal of this application. Without going into the merits of the matter, the application stands dismissed as withdrawn. The learned Sessions Judge seized with the Sessions Case No. 163 of 2016 shall make an endeavour to conclude the recording of evidence as far as possible within 9 months from the date of receipt of this order.

Hence, the application stands dismissed as withdrawn and disposed of accordingly.
