The challenge in the present Petition is to the order dated 6 April 2022 passed by the Collector of Stamps Enforcement-I, Mumbai demanding an amount of Rs.1,84,96,591/-. In pursuance of that order demand notice dated 15 May 2023 is issued. It is the case of Petitioner that the order dated 6 April 2022 was passed ex-parte.

Mr. Kanade, the learned counsel appearing for Petitioner would submit that during pendency of the Petition, the Collector of Stamps has given by SAJAKALI LIYAKAT JAMADAR Date:

904-wp-8719-2023.doc post decisional hearing to the Petitioner and has accordingly withdrawn the demand notice dated 15 May 2023. Petitioner is also permitted to advance submissions with regard to correctness of the order dated 6 April 2022 and the decision making process is under progress. Mr. Kanade therefore prays leave to withdraw the present Petition with liberty to file fresh Petition, in the event the order dated 6 April 2022 is maintained.

Reserving the liberty as prayed for, Writ Petition is permitted to be withdrawn and disposed of. All contentions raised in the Petition are kept open.
