By an order dated 20.6.2017 the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates.

Perused the record.

The first information report is lodged by Shri. Raju Baburao Palaskar, Rationing Officer, Thane. It is the case of the prosecution that after receipt of specific information, a raid was conducted on a shop of Public Distribution System (Rationing shop) licensed to Vishwanath Karlad, Manisha Nagar, Kalwa, District Thane. The said shop was found to be closed and after some time the applicant arrived at the same spot. It was noticed 1/2
Ashok Nalawade aba-1019-17-19 that the applicant was conducting the said shop. 4.
It was found that at that time the applicant and coaccused had stored more quantity of food grains than that was mentioned in the registers maintained by them. The present crime is therefore lodged under the provisions of Essential Commodities Act.

The record indicates that after the interim relief was granted in favour of the applicant, the applicant has attended the Investigating Officer on stipulated dates and co-operated in the procession of investigation. The necessary documents have already been seized by the police from the applicant. After perusing the record, this Court is of the view that for further investigation of the present crime custodial interrogation of the applicant is not necessary.

In view thereof, the interim relief granted by an order dated 20.6.2017 is hereby confirmed. However, the applicant is directed to attend the Investigating Officer as and when called for between from 10.00 a.m.to 1.00 p.m. and to join the process of investigation till submission of the final report. 7.
