Heard learned counsel for applicant and learned APP. This is an application for a limited relief of modification of order dated 13th May 2016 passed by Additional Sessions Judge, Thane, vide which, applicant on being released on bail, was directed to furnish P.R.bond of Rs.25,000/- with one solvent surety in like amount. Learned counsel for applicant submits that instead of furnishing one solvent surety, he be allowed to furnish one or two sureties.
The impugned order reveals that such prayer came to be rejected only on considering that applicant is involved in a serious offence. Having considered the fact that applicant was on merits considered to be entitled to be released on bail, prayer made appears to avk 1/2
29-APPLN-372-2016.doc be reasonable, as it appears that for this technical flaw, applicant though ordered to be released on bail about four months before, for want of compliance as aforesaid, could not be released on bail. In the circumstances, following order is passed :
i) Applicant shall be released on bail in Crime No.84 of 2016 registered by Wagle Estate Police Station on his executing P.R.Bond in the sum of Rs.15,000/- with one or two sureties in like amount.
Rest all the conditions as imposed by the learned trial court shall stand unaltered.
Application is accordingly disposed of.
