This Civil Application is for condonation of delay of 113 days caused in filing the First Appeal challenging the judgment and order dated 27/10/2017 passed by the Railway Claims Tribunal, Mumbai in Claim Application No.1250 of 2011.

This Court by order dated 19th July 2019 issued notice to the Respondents and made the same returnable on 2nd August 2019. At that time Mr.N.D.Sharma, learned Counsel appeared for the Respondent-Union of India and waived service on behalf of the Respondent-Union of India. Till date no reply is filed to the Civil Application. 3.

Ms.Gavkar, learned Counsel appearing for the Applicant submitted that there is sufficient reasons given in the delay condonation application. She submitted that therefore Civil Application be allowed. Perusal of Civil Application shows that sufficient reasons are given including financial constraints.

For the reasons set out in the Civil Application, the same is allowed in terms of prayer clause (a).
