By this application, the applicant has prayed for holding inquiry as to whether Smt. Alka Ashok Chavan has committed perjury and therefore, action needs to be initiated against her for offence in terms of section 195 (1) (b) of the Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') while deposing or producing documents in evidence. The applicant has also further prayed for issuing direction to the trial Court to proceed as per Section 340 of Cr. P.C. and after holding inquiry submit report to this Court.

The matter was heard at length on 13th July, 2018 and was ordered to be listed today for passing orders. 4.

Mr. Modgi, on instructions, seeks permission to withdraw the application. Mr. Shah has no objection for it. 5.

In view thereof, on the motion made by Mr. Modgi, C.A. is allowed to be withdrawn and as such is dismissed.
