Mr. Sait, learned APP, on instruction from the Investigating Officer, submitted that applicant No.1 is not an accused in the present Crime No.88 of 2017 registered with Chembur Police Station. That, applicant No.2 Virendra Chemburkar is an accused and he surrendered before the police on 13.07.2015 and has been arrested in the said crime. In view thereof, the present application for pre-arrest bail does not survive and is, accordingly, disposed off.
