P.C:- Ms. Inamdar, learned Counsel appearing for the Petitioner, on instruction, seeks to withdraw the Petition. She points out that the challenge in the Petition was to the order dated 28th November, 2012 which refused to stay the divorce proceedings for non-payment of the arrears by the husband to the wife. However, the arrears have now been paid, therefore, the Petition does not survive. Accordingly, Petition is dismissed as withdrawn. As the divorce proceedings is of the year 1995, it would be open to the parties to make an application to the Trial Court for expeditious disposal of the Marriage Petition. If such an application is made, the Trial Court will consider the same sympathetically. (M.S.SANKLECHA,J.) S.R.JOSHI
