Heard. The present petition is filed seeking direction to transferring the investigation of CR No.323 of 2016 registered with Tulinj police station, under Section 420 r/w Section 34 of Indian Penal Code.

The learned Counsel for the Petitioner states that though the Petitioner has been deceived by the accused, his statement is not recorded and the charge-sheet is filed. 3.

Mr. Saste, the learned APP on instruction states that, order under Section 173(8) would be procured from the concerned Court for further investigation and the statement of the Petitioner will be recorded in the subject crime and 1/2

44-wp2268-17.doc thereafter supplementary charge-sheet will be filed. He submits that entire exercise will be completed within three months from today. Statement is accepted.

In the light of the statement of the learned APP, the learned Counsel for the Petitioner fairly concedes that the demand made in the petition no more survives. The petition is accordingly disposed of.
