The Appellant/Applicant has challenged the judgment and award dated and 14/05/1999 passed by the Member, MACT, Nashik in MACP No.68/1991.

It appears that the department has raised an objection that separate decree in respect of MACP No.68/1991 needs to be filed instead of joint Decree/Award. The Applicant states that pursuant to the said objection, an Application was made before the Claims Tribunal to pass a separate Award in MACP No.68/1991. However, the same has been rejected.

Under the circumstances and also considering the fact that the Claim Petition No.68/1991 and two other claim petitions were disposed of by common judgment and award, the department to accept the common Judgment and Award.
