By this application, the applicants seek following reliefs :

35-APPA-828-2019.odt "(a) That this Hon'ble Court may be pleased to permit the Applicant to dispose off the property namely Shop No. 1 & 2, Prem Bhanu CHS Ltd, 4th Cross Road, I.C. Colony, Borivali - (West), Mumbai - 400 103 under an indemnity bond to the satisfaction of this Hon'ble Court on such terms and conditions as this Hon'ble Court may deem fit and proper;

(b) This Hon'ble Court may alternatively consider disposing off the present Appeal 491 of 2003 as expeditiously as possible within the period of 3 months from the date of passing the orders on such terms and conditions as this Hon'ble Court may deem fit and proper."

The aforesaid appeal be listed on 18th April 2023 for final disposal at 2:30 p.m.

Since we have listed the aforesaid appeal for final disposal, learned counsel for the applicants does not press for prayer clause (a).

The application is accordingly disposed of.
