The petitioner who claims to be Deputy Commissioner of respondent No.1- Ulhasnagar Municipal Corporation, by filing this petition under Article 226 of the Constitution of India, is challenging the promotion of the respondent No.3 to the post of Deputy Accounts Officer. An objection is taken by learned counsel for the respondent No.3 that the petitioner is not an aggrieved person and, therefore, he has no locus to file this petition. We find substance in the objection taken by learned counsel for the respondent No.3.

Mr. Kulkarni, learned counsel for the petitioner, however, submitted that he has made representation dated 5th March, 2019 to the respondent No.2 - Municipal Commissioner, Ulhasnagar Municipal Corporation in this regard, a copy of which is annexed at Exhibit J, page 83 and submitted that he would be satisfied if the Commissioner is directed to look into the same and decide the same. 3.

In the light of the above, we dispose of this petition by directing respondent No.2/competent officer to dispose of the petitioner's representation dated 5th March, 2019, a copy of which is annexed at Exhibit- J, page 83 as expeditiously as possible and preferably within a period of six weeks from the date of receipt of this order. 3.

It is made clear that we have not gone into the merits of the matter and the said representation shall be decided in accordance with law.
