IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.686 OF 2016 IN CIVIL REVISON APPLICATION NO.420 OF 2012 Bhagwat Banwari Pal ..Applicant Vs.

Subhadra Munshi Dayashankar ..Respondent Mr. G. S. Bhat for the Applicant Mr. R. D. Mishra for the Respondent CORAM :

R. M. SAVANT, J.

DATE :

6th APRIL, 2017 P.C.

The above Civil Application has been filed by the Applicant original Civil Revision Applicant for being permitted to deposit the compensation from June 2016 up to date in the Small Causes Court, Mumbai. Need for filing the said application has arisen in view of the fact that there is no specific order permitting the Applicant to deposit the amount of compensation, once there was a default which was committed by the Applicant of the order passed by this Court.

In my view, since the arrears up to May 2016 have already been deposited, it would be just and proper to permit the Applicant to deposit the compensation from June 2016 onwards up to date in the Small Causes Court, mmj

cac-686-16-(2) Mumbai. The same to be done within 4 weeks from date. The Registry of the Small Causes Court is directed to accept the same. The Civil Application is accordingly disposed of.
