The learned APP at the outset submits that in the Special Case No. 15/12, 11 witnesses are examined where the applicants are being tried under the provisions of MCOCA. In view this, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973 in the midst of the trial. Hence, the application stands dismissed.

13.ba1189.16.sxw The learned Counsel for the applicant submits that the trial be expedited. It appears from the record that the Special Court is conducting the trial expeditiously to the best of its capacity. Hence, specific directions would not be necessary. However, the Sessions Court is requested not to grant unwarranted adjournments to the prosecution and to the defence in the midst of the trial. The application is disposed of accordingly.
