DATE: FEBRUARY 12, 2020 P.C.:- 1] This revision is by husband, questioning the order of payment of maintenance.
2] I am informed that parties have settled their dispute and have tendered Consent Terms before the Family Court at Bandra in Petition No.E/320 of 2016 and Petition No. B/74 of 2016, both initiated by Respondent-wife against the Petitioner.
3] In the aforesaid Consent Terms, amongst other, parties have agreed to the following conditions which are necessary for disposal of 1/3
the present Revision Application:- (I) Respondent-wife shall be forthwith permitted to withdraw the amount of Rs 1,50,000/- deposited in this Court by the Petitioner-husband with interest, if any, accrued thereon.
(II) Brother of the Respondent-wife who is facing prosecution in Criminal Case No. 248 of 16 for the offences punishable under Sections 323, 324, 341, 427, 504, 506 II r/w Section 34 of IPC, for which proceedings in this Court will be initiated for quashing within a period of one week from today. (III)Petitioner-husband, who is present in the Court, assures and undertakes that he will extend consent for quashing of the said criminal proceedings against the brother of Respondent-wife. (IV)At the behest of Respondent-wife, Petitioner is 2/3
facing prosecution for the offence punishable under Sections 498(A), 406, 323, 504 and 506 of IPC and under Section 4 of Dowry Prohibition Act, which is a subject matter of challenge in Cri. APL No.638 of 2019. Respondent-wife, who is present in Court, assures and undertakes that she will extend consent for quashing of the said proceedings, so as to take the Consent Terms tendered before the Family Court to its logical end.
4] As parties who are present in Court have undertaken to abide by aforesaid terms, a joint request is made for disposal of the present Criminal Revision Application in the above terms. 5] Criminal Revision Application is disposed of in the aforesaid terms.
