This MCA seeks transfer of a matrimonial proceeding for divorce, being Petition No.A-350/2015, from the Family Court at Pune to the Family Court at Bandra, Mumbai.

Learned Counsel for the Respondent tenders a copy of the roznama of the pending petition available on the website. The roznama shows there have been several dates when the matter was heard by the Family Court at Pune; the evidence was closed in the petition and the final arguments were also heard. The petition appears to be practically closed for orders (after the oral submissions and written arguments filed by the Respondent in the pending matrimonial petition). The matter is reserved for one final opportunity to the Applicant (Respondent in the pending petition) for arguments and if the matter is not argued, the court is likely to pronounce its judgment. On these facts, there is no question of transferring the pending matrimonial petition from the court at Pune to the Family Court at Bandra, Mumbai.

The MCA is, accordingly, rejected.
