Heard the learned counsel appearing for the Petitioners and the learned counsel appearing for the Nashik Municipal Corporation (Second Respondent). Application for grant of development permission made by the Petitioners which is annexed to the Petition (Exhibit-D to the Petition) is still pending. The learned counsel appearing for the Municipal Corporation states that during the pendency of the Petition, a representation has been received from the Petitioners requesting the Municipal Corporation to grant development permission.

Hence, we dispose of the Petition by passing the following order :-

ORDER

(i) We direct the second Respondent to take appropriate decision on the pending application for grant of development permission as expeditiously as possible and in any event within a period of two months from today; (ii) All contentions on merits are kept open; (iii) The Petition is disposed of on above terms.
