Heard Mr. Deshmukh, learned Advocate for Respondent. 3.
This Writ Petition takes exception to the order dated 31.01.2018 of dismissal of Appeal on merits by the Appeal Court. The Trial Court has dismissed the Suit proceedings as informed by Mr. Deshmukh, learned Advocate for the Respondent who is Defendant in the Trial Court. He would submit that Suit was dismissed comprehensively by the learned Trial Court against which a substantive Appeal was preferred and the said Civil Appeal has also been dismissed on merits. Remedy against such dismissal of the Civil Appeal on merits cannot be by way of filing a Writ Petition.

It is seen that this Writ Petition is filed in the year 2018 and has been on board on 3 earlier occasions. On all 3 occasions, none appeared for the Petitioners.

In any event, in view of the aforesaid observations, Writ Petition is not maintainable and therefore stands dismissed. 6.
Writ Petition is accordingly dismissed.
