The petitioner in response to the advertisement dated 3rd October 2017 issued by the Maharashtra Public Service Commission sought recruitment on post of "Police Sub-Inspector." It is her grievance that the horizontal reservation worked out by the respondents was not in accordance with the settled legal position. In that regard, the petitioner made representation dated 9th November 2020 to the Secretary, Maharashtra Public Service Commission as well as to the Secretary, General Administrative Department, Mantralaya, Mumbai. 2.

By the order dated 25th February 2022, this Court had directed the respondents to consider the petitioner's representation. The

ppn 2 907.wp-5724.21.doc learned Additional Government Pleader, however, submits that instructions in that regards are still awaited. 3.

Considering the fact that the petitioner's representations are pending with the respondent nos.1 and 2, the interest of justice would be served by passing the following order :- (i) The respondent nos.1 and 2 shall consider the petitioner' s representation dated 9th November 2020 in accordance with law and take a decision thereof within a period of eight weeks from today. The decision taken be communicated to the petitioner. (ii) If the petitioner is aggrieved by the decision taken on the said representations, she is free to take appropriate legal recourse in accordance with law.

(iii)Keeping all points raised in the writ petition open, the writ petition is disposed of in aforesaid terms. Order accordingly. JITENDRA JAIN, J.
