As this petition cannot be taken up by the regular Bench, as per general order passed by the Hon'ble the Chief Justice, the same will have to be taken up by this Bench. 3.

We have heard the learned counsel appearing for the petitioners. The prayer is for quashing and setting aside the charge-sheet dated 25th June, 2015 for offences punisable under Section 498A, 406 read with 34 of the Indian Penal Code. The petitioners have remedy available before the concerned Court. Therefore, the substantive prayer in terms of prayer clause (B) 1/3

cannot be entertained in writ jurisdiction. As far as prayer clauses (C) and (D) are concerned, the petitioners are not pressing the same.

Hence, we decline to entertain this petition. The remedy of the petitioners is kept open and all contentions on merits are also kept open. The petition is disposed of in the above terms. (V.L.ACHLIYA, J.) (A.S.OKA. J.) 2/3
