1] Heard learned Counsel for the applicant. Though the respondents are duly served, no one appears on their behalf when the matter was called out.

2] This application is preferred by the applicants/ claimants for condonation of 250 days delay in filing the first appeal, challenging the judgement and award dated 18th July 2012 passed by Motor Accidents Claim Tribunal, Solapur in Motor Accident Claim Petition No.319 of 2012 for enhancement in compensation.

2/4 3] Considering the submissions made by the learned Counsel for the applicant and averments made in the civil application, I am satisfied that the applicant has made out a case of condonation of delay in filing first appeal. Accordingly, the application is allowed in terms of prayer clause (a) which reads as under:- "(a) This Court be pleased to condone the 250 days delay in filing the present first appeal"
