Heard learned counsel for the petitioner, learned APP for the State and learned counsel for respondent nos. 2 to 9. 2.

Petitioner is original complainant and respondent no. 3 is his wife. There is also decree of divorce. The consent terms have also been recorded by this court on 20/11/2014 in Criminal Writ Petition No. 480 of 2014.

It appears that because the consent terms were not adhered to, contempt petition was taken out by the husband and in that contempt petition he has given undertaking to get the present prosecution quashed by filing appropriate proceedings. nilegaonkar 1/2

In view of this admitted position on record, we make the rule absolute in terms of prayer clause (a) and accordingly quash S.C.C. No. 445 of 2014 in the court of J.M.F.C. Yeola. (SARANG V. KOTWAL, J.) (B.P. DHARMADHIKARI, J.) nilegaonkar 2/2
