This application is for restoration of First Appeal No.187 of 2015 with Civil Application No.489 of 2015 which was dismissed for noncompliance of conditional order dated 13.3.2015 passed by this court.

The learned counsel for the applicant submits that applicant undertakes to comply the earlier order dated 13.3.2015 within four weeks from today.

Statement is accepted.

Considering the submissions made by the learned counsel for the applicant and the averments made in Civil Application, following order is passed:

23 caf2328-15.doc a) Time is granted to the applicant to comply the order dated 13.3.2015 till 4.9.2015 failing which Civil Application shall stand dismissed without referring back to the court.

b) First Appeal No.187 of 2015 with Civil Application No.489 of 2015 is restored on file for hearing on its own merits.

c) Civil application stands disposed off accordingly.
