Heard learned counsel for the petitioners, learned additional public prosecutor for the State and learned counsel for the respondent no.2.

Perused the order dated 24th July, 2015. The petitioners were supposed to pay Rs.16 lakhs today by way of last installment of full and final settlement of the amount involved in this case. A cheque of Rs.16 lakhs is given by the petitioners to the Advocate for the Respondent No.2. Borey 1/2

spb/ 11wp2462-15.sxw In view thereof, the offence punishable under section 138 of the Negotiable Instruments Act stands compounded.

The orders passed by the learned Magistrate in criminal case no.1154/SS/2013, issuing the process and the order by the learned Additional Sessions Judge in criminal application no. 18 of 2015, dismissing the revision application of the petitioners, are set aside.

The petitioners are discharged of the offence punishable under section 138 of the Negotiable Instruments Act. Their bail bonds, if any, shall stand cancelled. The writ petition stands disposed of.
