The learned counsel for the applicant submitted that respondent nos. 1(a) and 1(b) who are legal heirs of respondent no. 1-Deepak Kothari are served. Respondent No. 2 is also represented by an advocate. However, none present for the respondents. 2.

The learned counsel submitted that there is a delay of 17 days in filing the Appeal from Order. He submitted that inadvertently, the application for certified copies was remained to be made by the clerk of the Advocate and therefore, the delay is caused. 3.

In view of the reasons given in paragraphs 8 and 9 of the Application and due to uncontroverted submissions, delay of 17 days 1 / 2
