4TH MARCH 2015 P.C. :- Heard learned counsel for the parties.

2] This application is for bringing the legal heirs on record of deceased Respondent No. 6 as per the will and testament dated 3001-2008. The learned counsel for the Respondents submit that they have no objection if the Civil Application is allowed. 3] Considering the said submission and the averments made in the Civil Application and no objection given by the learned counsel 1/2

Vsp 25-caf-3118-2014 on behalf of the Respondents, I am of the opinion that the Applicants have made out case for allowing the Civil Application. 4] Civil Application is allowed in terms of prayer clause (a) which reads thus:

A] That the Hon'ble Court may be pleased to implead the proposed Respondents as Respondent Nos. 6A to 6C in place of Original Respondent No. 6 in First Appeal No. 347 of 2008. B] The Applicants are directed to carry out appropriate amendment and serve an amended copy of the First Appeal on the Respondents within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the Court.

5] The learned counsel for the added Respondents waives service of First Appeal No. 347 of 2008.

6] Civil Application stands disposed of accordingly. (K.K.TATED, J.) 2/2
