PER COURT :

The Applicant is arrested on 14th February, 2021 in connection with C.R. No.69 of 2021 registered with Talegaon Dabhade Police Station for offences 307, 326, 143, 144, 147, 148, 149, 504, 506 of Indian Penal Code. First Information Report registered on 9th February, 2021.

The case of the prosecution is that on 9th February, 2021. The applicant and his associates were armed with weapons assaulted the injured with weapons. The assault was mounted on head and other parts of body. The injured suffered several injuries. 3.

The medical injuries certificate pointed by learned counsel for the applicant indicate that the victim had suffered two grievous injuries. The other accused are absconding.

Learned Advocate for the applicant submitted that the applicant is in custody for one year and eight months. There is no progress in trial. There are no criminal antecedents against the applicant.

Learned APP submitted that the assault was brutal. The injured had suffered several injuries. The applicant and his associates were armed with and dangerous weapons. Bail should not be granted.

It is pertinent to note that investigation is completed and charge-sheet is filed. The assault was mounted by several accused. The others are absconding. The applicant is in custody for substantial period of time. On certain stringent condition the applicant can be granted bail.

ORDER

i.

Criminal Bail Application No. 2656 of 2021 is allowed; ii.

The applicant is directed to be released on bail in connection C.R. No.69 of 2021 registered with Talegaon Dabhade Police Station on executing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount; iii.

The applicant is permitted to furnish cash bail in the sum of Rs.25,000/- for a period of eight weeks in lieu of surety.

iv.

The applicant shall stay out of the jurisdiction of Talegaon Dabhade Police Station till further orders. v.

The applicant shall report concerned Police Station once in three month on first Saturday of the month between 11:00 a.m. to 1:00 p.m., except for attending the said police station the applicant shall not enter the the jurisdiction of said police station.

vi.

The applicant shall attend the trial Court on every date of hearing unless exempted by the Court.

vii.

Application stands disposed of accordingly.
