The applicant came to be arrested on 07/02/2020 in crime no. 113 of 2020 registered with Kondhwa police station for the offence punishable under sections 363, 376(2)(n) of IPC & under sections 4, 8 & 12 of the POSCO Act.

The prosecution case is non-applicant/victim is below 18 years, eloped with applicant as they were in love with each other. The victim appears to be close friend of the sister of the applicant. 3.

The counsel for the non-applicant/victim on instructions submits that the non-applicant/victim has no objection for grant of bail provided the applicant shall not contact the non-applicant/victim girl or try to influence her directly or 1/3

I have perused the investigation papers.

The non-applicant/victim appears to have developed afÏnity with the applicant and as such, both have eloped together. 6.

The applicant is also in his younghood i.e. 19 years on the date of commission of the offence.

The investigation in the matter is already over. There are no criminal antecedents against the applicant.

As such, case for bail is made out.

The applicant be released on bail in crime no. 113 of 2020 registered with Kondhwa police station for the offence punishable under sections 363, 376(2)(n) of IPC & under sections 4, 8 & 12 of the POSCO Act upon furnishing P.R. bond in the sum of Rs. 15,000/- with one or more sureties in the like amount. 10.

The applicant shall neither influence the witnesses nor tamper with evidence in any manner.

Till the trial is completed the applicant shall stay away from the jurisdiction of the concerned police station. 12.

The applicant shall not contact with the non-applicant/victim or her family members directly or indirectly till the conclusion of trial.

The applicant shall regularly attend the trial, failing which Trial Court will be entitled to initiate proceedings for cancellation of bail.

14.

The application stands disposed of.
