1) This is an application for suspension of sentence and releasing applicant on bail.
2) By the Judgment and Order dated 25.8.2010, the applicant has been convicted under Sections 354, 323, 504 and 506 of the Indian Penal Code and sentenced him to suffer maximum simple imprisonment for six months and to pay fine of total Rs.11,500/- by the learned 2nd Joint Judicial Magistrate First Class, Waduj, District-Satara in Criminal Summary Case No.376 of 2006 by its Judgment and Order dated 25.8.2010. The Criminal Appeal bearing No.74 of 2010 preferred by the applicant against the said Order is dismissed by the learned Additional Sessions Judge, Vaduj by its Judgment and Order dated 25.5.2016.
Dond 1/2 appr.347-2016.sxw 3) The maximum substantive sentence imposed upon the applicant is of six months simple imprisonment. This is a short term sentence. The substantive sentence imposed upon the applicant is hereby suspended during the pendency of the present Revision Application subject to condition that the applicant shall deposit the entire fine amount as directed by the Trial Court, if not deposited earlier.
Hence the following Order:- (i) The applicant be released on bail immediately on his furnishing PR bond of Rs.15,000/- with one or two local sureties in the like amount.
(ii) After his release from jail, the applicant shall attend the Trial Court once in three months on every first Monday between 11.00 a.m. to 1.00 p.m.
(iii) Any two consecutive defaults in attending the Trial Court will attract the provisions of cancellation of his bail granted by this Court. 4) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
