Though the Respondents are duly served, no one appeared when the matter was called out.

By this civil application, the Applicant is seeking condonation of 44 days' delay in filing the First Appeal, challenging the judgment and award dated 23rd January, 2015 passed by the Motor Accident Claim Tribunal, Karad in M.A.C.P. No.99 of 2009.

Considering the submissions made by the learned counsel for the Applicant, and the averments made in the civil application, I am satisfied that the Applicant has made out a case for allowing this civil application. Hence, following order:

ORDER

(A) Civil application is allowed in terms of prayer clause (a), which reads thus:

"A) That this Hon'ble Court be pleased to condone the delay of 44 days in filing the present First Appeal and direct the Registry to register the present First Appeal."
