At the outset, learned A.P.P, on the instructions of the Investigating Officer, who is present in Court, makes a statement that charge-sheet will be filed in the said case within one week from today. The said statement is accepted.
In view of the aforesaid statement made by the learned A.P.P, learned counsel for the applicant does not press this application and seeks leave to withdraw the same, with liberty to file a fresh application in the trial Court, after filing of the charge-sheet. 2/3
The application is accordingly disposed of as withdrawn with liberty as prayed. All contentions of the parties are kept open. It is made clear that the application has not been heard on merits and if an application is filed after filing of the charge-sheet, the same shall be decided by the learned Judge, on its own merits, uninfluenced by the withdrawal of this application. In view of the above, the intervention applications also stand disposed of.
