Parties through their Counsel. Having heard the learned Counsel for the parties we find that in the impugned order dated 1st June, 2016 Exhibit-E the Additional Commissioner Pune while rejecting the Petitioner's application of disqualifying the Petitioner from the post of

WP.7778/2016(P-7) Member of Grampanchayat have been assigned no reasons. Since the order is nonspeaking order and the same having been passed mechanically we set aside the same. The Commissioner is directed to decide the Petitioner's appeal itself finally by passing speaking order. Till the Commissioner decides the appeal the operation of the impugned order passed by the Collector, Kolhapur shall remain stayed. The appeal to be decided by the Commissioner within 2 months from the date of receipt of copy of this order. The Petition is disposed of accordingly.
