Considering the submissions made by the learned counsel for Applicant and averments made in Civil Application, we satisfy that the Applicant has made out a case. Hence the following order :- VRD
CAM169.2017.sxw "A) Civil Application is allowed in terms of prayer clause (a) which reads thus :- "this Hon'ble Court be pleased to allow the Petitioner to make amendment to the grounds of Memo of Appeal No.126 of 2015 by adding the paragraph Nos.4 to 7 of this Civil Application in the Memo of Appeal No.126 of 2016."
B) Petitioner to carry out amendment within four weeks from today with amended copy to the other side and file affidavit of service to that effect, failing which Civil Application shall stand dismissed without reference to the Court.
C) No order as to costs.
