DATE : December 12, 2018 Prayer is to condone delay in bringing on record the legal heirs of appellant No.3.

The prayer as made is opposed by the respondents by filing reply to the Civil Application.

It is a fact that appellant No.3 expired on 18/10/1995. However, his brothers who are appellant Nos.1 and 2 are already on record. The estate of the deceased was thus partly represented. In that view of the matter the delay in bringing on record the legal heirs of appellant no.3 stands condoned. The cause title of the appeal be amended within period of four weeks.
