This is a subsequent application. Earlier application was rejected on 28th November, 2016. There is no change in circumstance. Learned counsel for the applicant fairly submits that the charge is framed. Needles to state that the trial has commenced and the learned Sessions Judge would take every effort to see that the trial proceeds without granting any adjournments either to the prosecution or to the defence. Learned counsel for the applicant, upon instructions, seeks liberty withdraw the application. Liberty as prayed for is granted in the interest of justice.
