Heard. The applicant has initiated present proceedings for expeditious disposal of the proceedings pending on the file of Judicial Magistrate First Class, Tasgaon bearing Criminal Misc. Application no. 79 of 2013. It is the submission of the learned counsel for the petitioner that said proceedings are more than five years old and as such, same are are required to be decided on priority basis.

2 15.2309.17 wp The fact remains that the petitioner has not moved any such prayer before the learned Magistrate's Court and has straightway approached this Court with a prayer for expeditious disposal of the proceedings pending on the file of the learned Magistrate. In my opinion, the interest of justice could be secured by giving an opportunity to approach the same Court with a prayer for expeditious disposal of the proceedings which are initiated and pending against him.

If such application is moved, the learned Magistrate shall deal with the same in accordance with law. With above observations, petition stands disposed of.
